A BLACKBURN tanning salon owner has been given a 12-month conditional discharge after a man she paid to dispose of rubbish from the shop dumped it in Oswaldtwistle.

Business owners have a duty of care to dispose of waste from their commercial premises responsibly and legally.

At Hyndburn magistrates, Donna Beck, 39, of Pritchard Street, Blackburn, admitted failing in that duty of care.

Gordon McMillan, prosecuting for Hyndburn Council, said a substantial amount of rubbish, including shelving and work surfaces, was found fly-tipped in Oswaldtwistle, in the summer. Council officers searched the rubbish and found letters addressed to Beck.

Mr McMillan said: "She said two blokes in a van had come round and asked for rubbish and she had paid them £150 for it to be taken away. She said she thought it was legitimate.

Andrew Church-Taylor, defending, said Beck was not aware of the obligation she was under. She was ordered to pay £250 towards cleaning up the waste, and £100 court costs.
