A 27-YEAR-OLD Oswaldtwistle man ejected from a shop returned carrying a brick, a bottle of pop and a pint glass - which he threw against the shop window.

Blackburn magistrates heard that when police arrived and arrested Lee Paul Brown he struggled violently and kicked an officer.

Brown, 27, of Lime Avenue, pleaded guilty to using threatening behaviour and assaulting a police officer. He was sentenced to two months in prison.

Daniel King, defending, said the incident had taken place at the Happy Occasions newsagents.

"This was not a happy occasion but my client does not accept everything that the prosecution say," said Mr King.

"He accepts throwing a plastic bottle at the window but with no intention to damage it.

"He also accepts kicking out while he was being manhandled into the back of a police van but he did not deliberately kick the officer."

Mr King said that as a result of the offences Brown had been recalled on licence to serve the outstanding six months of a custodial sentence.

"In effect he has already been given a six-month prison sentence for this offence and I hope you can deal with him without extending the date of his release in March," said Mr King.
