A FATHER-to-be who moved his friend's car a short distance outside a takeaway has lost his driving licence - before he had even got it.

Burnley Magistrates heard that Michael Webb, 20, faced being banned but had never actually passed a driving test.

The defendant, of Barry Street, Burnley, admitted driving with excess alcohol, no licence and no driving licence. He was fined £300, disqualified for two years and ordered to pay £55 costs.

Andy Robinson, prosecuting, said police saw a car parked on the pavement, with the engine running, outside a takeaway on Lower St James Street, Burnley. It then drove off, swerving across the road and when police stopped the defendant, they noticed he smelled of drink.

A roadside breath test proved positive and the lower of two police station tests showed 89 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35. Webb had no previous convictions.

Geoff Ireland, defending, said Webb had been out with a group of lads in Padiham and had a lot to drink. One of the group who had been driving had not had a drink and decided he would go into Burnley to get some food.

The friend parked on some double yellow lines outside a takeaway and a police officer told them to move on.

Webb foolishly jumped into the driver's seat and drove around the corner, for perhaps about 50 yards. IT was a stupid thing to do.
