A 38-YEAR-OLD man saw red when he caught his partner in the arms of another man.

Blackburn magistrates heard Bernard Kinyua knocked the other man unconscious and assaulted Carol Horrix when she tried to intervene.

Kinyua, of West Street, Nelson, pleaded guilty to assaulting John Anderton causing him actual bodily harm and assaulting Miss Horrix.

He was sentenced to 12 weeks in prison suspended for 12 months and made subject to a 25-day rehabilitation requirement.

He was ordered to pay £200 compensation to Mr Anderton, £85 costs and £115 victim surcharge.

Andrea Fawcett, prosecuting, said all three people involved were at a party at a Nelson pub.

“In the course of the night Miss Horrix and Mr Anderton had a hug in a corridor and this was seen by the defendant,” said Mrs Fawcett.

“He slapped and punched Mr Anderton and as they came out of the pub pushed him again causing him to fall. He was unconscious for a period of time and later needed five stitched in a cut to his forehead.”

She said Miss Horrix was pushed when she tried to stop the assault and suffered minor injuries. She did not support the prosecution and refused to make a statement.

Geoff Ireland, defending, said Kinyua was a hard working individual who was not a violent man.

He said: “He acted on the spur of the moment when he saw his partner in an embrace with the other man.”
