Lancashire landlord who flouted smoking ban out of jail


A LANCASHIRE pub landlord who flouted the smoking ban, has walked free from prison after an online campaign raised enough money to pay his fines.

Nick Hogan was fined £3,000 and ordered to pay £7,136 in costs when he was found guilty of breaching the ban in January 2008.

Hogan, 43, of Hollinshead Street, Chorley, had failed to pay the money and was sent to prison for six months by Bolton Magistrates Court.

But the former landlord of the Holden Arms in Haslingden and the Waterside pub in Summerseat, whose wife Denise runs The Swan With Two Necks in Chorley, has now walked free after serving 11 days of his sentence.

Speaking outside Forest Bank prison in Salford, Hogan, 43, said: “I was devastated to be sent to jail.

"The smoking ban has cost me my pub, my job and my liberty.

“I’d like to thank everyone who donated money to get me out of jail, and all the well-wishers who sent me cards and letters while I was behind bars.

"I can’t thank them enough.

“It’s wonderful to know that so many people feel as strongly as I do about the smoking ban and its impact on ordinary working people.”

The campaign to pay Hogan’s fines was launched by blogger Anna Raccoon with the help of fellow libertarian blogger Old Holborn, who set up an account so people could donate online.

Within 36 hours over £5,000 had been raised. A further £1,200 was donated over the next two days.

By the end of last week donations totalled more than £9,000, enough to pay.

Why?

Law-breaking on such a big and dangerous scale justified a spell inside. Rather that than forcing people to risk the potential harm of breathing in their second-hand foul expiration of dangerous air.

In a democracy we could have had pubs which were either smoking or non-smoking, or rooms set aside in pubs for smokers. Bar staff would know the type of pub beforehand so could decide whether to apply to work there or not. So smokers, (i'm not one), would have a choice of pub to frequent, happy in the knowledge they wouldn't have to listen to the "second hand foul expiration of silly comments from the likes of Chris P Bacon and Mikebuk, who obviously don't subscribe to the concept of democracy.

We, as individuals, should have the choice. We are adults.

It shows how much people are annoyed at this removal of the freedom of choice. everybody knows there was a better compromise, but the intolerance of the health fascists won the day. now is the time to re visit the smoking ban and allow people a choice. The way to stop people smoking is through education. you can not treat grown ups like criminals, and then take tax on the products they use.
Freedom was hard won in this country and will not be given up lightly.

What a deranged viewpoint. The law introduced is a tremendous benefit in extending people's lives. The removal of the foul fog of polluted air in confined spaces will help increase the lifespan of people as it will reduce or eliminate the potential of respiratory diseases such as emphesima and lung cancer. That's not 'ruining the country', it's benefitting the country.

And you're right, we should have the choice as adults and our choice is to be protected from being forced to breathe in dangerous air from the lungs of self-centred morons.

How about "don't go in the pub if you want to smoke!". Its the smoker that causes the prolem not the non smoker. It should be nothing to do with the law its just plain manners.

There should be pubs for both but unfortunatley the non smokers have to go to the smoking pubs because smokers are so weak willed that they seem unable to go for any length of time without needing a fag. How often have you been out for a meal with a big group of people and the table is deserted between courses as the smokers need to go outside? how ridiculous is that. I used to do it and looking back its madness!!

Nick Hogan was sent to jail for refusing to pay his fine, not for the actual offence itself.

Even as a non-smoker I can see the enormous detriment this has had on the Pub Trade.

I never saw what was wrong with just having non smoking areas.

When I say get rid of all smokers and drinkers, and higher council tax and petrol tax by more that 100 percent in order to recoup the loss, lets see how much you hate the foul smell of smoke, because you'll need to get acustom to the smell of being ripped off

Of course I'll happily go in to any pub I want to as I am no longer forced to breathe in the vile expiration of the self-centred morons who care nothing for their own health so why should they care for another's?

Why cant there be establishments devoted to smokers? A smoking club which also has a license to serve alcohol. Non smokers get their smoke free pubs, everyone is happy. Otherwise smokers will have their gatherings or parties at home thus losing the government millions in tax revenue.

Loony Fringe? I haven't a clue who the English Democrats are but I'd have to make it my bussiness to find out who/what they are before, I stick them with any label.
